Terms of Service

Once you proceed with your purchase you are entering into a contract with Lost In time for the creation of a unique and beautiful handcrafted piece. Due to the the nature of this process, each product will be distinct and it may vary from the original fresh flower arrangements! 

Below is a detailed purchase agreement. By completing your purchase, you are confirming that you have read, understood, and agreed to these terms!  As a condition of purchase, you are required to sign this with the acknowledgment, understanding, and agreement to all applicable terms. 

TERMS OF SERVICE

You acknowledge and agree that you are solely responsible for arranging and covering all costs associated with the delivery and shipping of your flowers or any additional items to Lost In Time! Lost In Time takes no responsibility for any damages or loss or delays that may occur during transit. Therefore you must waive any claims, or remedies against Lost In Time for the loss, delays, or damages that occur before they have arrived at our premises. 

You acknowledge and agree that your flowers or items will be preserved and worked with in the condition in which it is received. Lost In Time is not responsible for any pre-existing damage or condition of the flowers or items upon arrival. 

You understand and acknowledge that the drying process, pressing process, and  preservation process naturally alters flowers, resulting in changes such as, color variations the appearance or enhancement of bruises, translucent spots, and the formation of some bubbles. Additionally, the flowers may shift slightly within the resin during the preservation process. These changes are inherent to the preservation method and are not considered defects.

You acknowledge and agree that if your bouquet is lost or damaged during shipping or delivery, Lost In Time will not be held responsible. We are not responsible for the monetary value of your flowers or items or any incidental or consequential losses or damages.

You acknowledge and agree that Lost In Time is not responsible for flowers or items that are lost, damaged, or stolen during transit. All risk associated with shipping remains only your responsibility! 

You acknowledge and agree that Lost In Time will issue a refund of up to the total amount you paid for your order in the event that there was damages to the items I made you upon receiving them. And only will you be refunded for that specific item that was ruined. You waive any right to claim damages or seek compensation beyond the amount you paid, including any additional claims against Lost In Time. 

You acknowledge and agree that if your flowers or items arrives in the condition deemed unworkable by Lost In Time, your order will then be canceled and you will receive a refund.

You acknowledge and agree that if you send flowers that have been dried in advance, Lost In Time is not responsible for any rot, mold, hairs that may be visible or develop during the preservation process.

You acknowledge that Lost In Time reserves the right to decline the preservation of any flowers or items that arrive in a damaged or wilted condition, where our designer deems the preservation process unlikely to succeed. In those cases, Lost In Time will not be held responsible for the costs of returning the wilted or damaged flowers or items. However, we can try to figure out different ideas we could make with them and if we can't then we will send them back if you cover costs of shipping them back!

You acknowledge that resin may naturally yellow or amber over time. Even under optimal conditions, this is a standard process, and Lost In Time assumes no liability for such changes. Additionally, flowers preserved in displays may change color or even brown over time, and Lost In Time is not responsible for these natural alterations that occur as part of the preservation process. 

You acknowledge and agree that any additional items that are sent or put into resin can no longer be removed once placed inside! 

You acknowledge and agree that Lost In Time retains the irrevocable and unrestricted right to photograph and/or film all products created through our services, including but not limited to your fresh or dried flowers, any additional items, the preservation process, and the final finished keepsake!  These images may be used at our sole discretion for any and all promotional purposes, including but not limited to display on our website, print or digital advertisements, social media content, any type of marketing, and promotional videos.

Additionally, any photos or media that you voluntarily provide to Lost In Time - Such as wedding, prom, or any event photos - Will be considered granted with full permission for use in our marketing and advertising materials. This includes, but is not limited to, organic and paid placements across any social media channels, our website, promotional anything, and other branded content.

We reserve the right to create visual or video content using your submitted photos and our own studio photography, showcasing your flowers or additional items (before and after), the artistry of the whole preservation process, and the final product!

By proceeding with our services, you grant Lost In Time with the unrestricted rights to use, edit, reproduce, and publish any associated imagery for marketing and promotional purposes in perpetuity, without compensation or additional approval required. 

You acknowledge and agree that not all of your flowers in your bouquet (or what you have sent me) may be used for preservation due to factors such as thickness, flower condition, or limited space in the design mock-up and or frame! If you have a lot left over you can add additional pieces or you can add the glass jar that holds all of your precious flowers and that will be sent back to you along with your keepsakes that I have made you!

You acknowledge and agree that ribbons, pendants, and lace may not be included in the final preserved piece unless I agree to it. If you send those items with your flowers and you don't want them in it or I haven't agreed  to put them into the keepsake, then you are responsible for covering the costs to send them back to you! If you don't pay for the return of them, then they will be discarded!

You acknowledge and agree that if your shipping address changes before your product is complete and is shipped, it is your responsibility to let us know that your address has changed! Lost In Time is not responsible for address changes not made in time.

Lost In Time retains the right to cancel any order at its sole discretion if in its professional judgment, the client relationship is not conductive to a successful or satisfactory outcome.  

You acknowledge and understand that the turnaround time for your order, in relation to your event date, may be subject to change due to factors that could delay  Lost In Times delicate preservation process. This includes, but is not limited to, the need for a flower reorder or other unforeseen circumstances.

Lost In Time shall not be held responsible or liable for any injuries or damages sustained in connection with the use or handling of the product!

You acknowledge that it is your responsibility to ensure that your flowers and all contents are properly labeled within the the shipment box before sending it out. If you gave us the wrong address Lost In Time is not held liable or responsible for it. Any unmarked items will be discarded.

You acknowledge and agree that a signature will be required upon delivery of your final product due to its sentimental value and cost, ensuring it reaches the correct recipient. If you choose to waive this signature requirement, you understand that it must be done by emailing Lost In Time prior to the shipment of your order.  

You acknowledge and agree that your order will not be shipped until all outstanding balances have been paid in full.

You acknowledge and agree that there is no set price on shipping. Once I have finished you product I will let you know the cost of shipping and you will pay for the shipping before sending it to you! Lost In Time is not liable or responsible for the loss or damage of the items being shipped back! We take careful care in protecting and shipping your items to you so if it arrives damaged that is not our doing! However, if it got badly damaged we can see if we can fix it with an additional charge!

Once you have agreed to the contract and purchase then we will send you this contract and terms of service over to you to sign! We will not start on anything until the contract has been signed and dated!
